CLARKSVILLE, TN (CLARKSVILLE NOW) – Rep. Mark Green of Clarksville has introduced the ADA Improvement Act of 2023. The bill amends the Americans with Disabilities Act to give businesses an opportunity to correct violations before a civil lawsuit is brought against them.

ADA lawsuits can occur when a person finds shortcomings of ADA compliance within a business. Typically, a business will hire a lawyer, and if no issue is found, then they will defend the business in court.

The importance of having access to any building for Americans with disabilities is vital. However, under the law today, trial lawyers are using the Americans with Disabilities Act against small businesses, Green said. “We must protect our job creators from these predatory lawsuits,” he said.

In a statement released from Washington, Green stated, “My common sense reform to the ADA will allow businesses the opportunity to address violations while ensuring all Americans have access to their facilities. Exacting a pound of flesh from small businesses for minor ADA violations might satisfy predatory lawyers, but it is not in the best interests of those with disabilities, job creators, our communities, or the economy.”
