CLARKSVILLE, Tenn (CLARKSVILLENOW) – A recent alert from the Department of Justice (DOJ) warns businesses of cards and flyers claiming that the owner is exempt from wearing face masks. The information on these cards has been neither issued nor endorsed by the DOJ.

The statement, released on ADA.gov, reads, “The Department of Justice has been made aware of postings or flyers on the internet regarding the Americans with Disabilities Act (ADA) and the use of face masks due to the COVID-19 pandemic, many of which include the Department of Justice’s seal.”

“These postings were not issued by the Department and are not endorsed by the Department.”

The card in question has primarily been circulated via the Freedom to Breathe Agency (FBTA), an online group opposed to any mandates requiring mask usage. Their website features printable ‘tools,’ including the card in question, claiming to offer exemption from any mask requirements under the ADA and the Health Insurance Portability and Accountability Act (HIPAA).

“I am exempt from any ordinance requiring face mask usage in public,” says the card. “Wearing a face mask posses a mental and/or physical risk to me. Under the Americans with Disability Act (ADA), I am not required to disclose my condition to you.”

The card further claims that asking questions can result in a fines of $75,000 or more.

According to the DOJ, the card is not valid. They, along with the CDC and other health experts, further encourage the public not to believe that wearing a mask could pose a physical or mental risk for most people, as claimed by the FTBA card.

The DOJ recommends that those with questions or concerns visit ADA.gov for information issued by the department. Those concerned about adverse effects from wearing a mask are encouraged to speak with their doctor or primary health professional.

Monday, June 6, Montgomery County Mayor Jim Durrett issued Emergency Order #9, mandating the use of masks by businesses and their employees until July 15 with the expectation of extending the order another seven days.
