MONTGOMERY COUNTY, Tenn. (CLARKSVILLENOW) – A Montgomery County man who was found guilty in his wife’s shooting death has been sentenced to serve four years in prison.

Court documents show that 34-year-old Benjamin Luck pleaded no contest in April and was sentenced this week.

Luck was initially charged with premeditated first degree murder but the charge was changed to voluntary manslaughter.

Luck was found guilty in the shooting death of his wife, 35-year-old Daria Paulina Luck, at a Cumberland Furnace home in May of 2016.

According to an arrest warrant, Luck told investigators he and his wife had been involved in a domestic dispute and the victim told Luck she intended to kill him. He then retrieved a gun and his wife retrieved a knife.

Luck said he feared for his life and shot his wife multiple times.

The warrant says after the initial shot, the victim was retreating and he continued to fire into what he believed was her back. He said he was unaware if she still had a knife at that time or if she was still a threat.

The victim collapsed on the couch and he did not see a knife in her hands, but shot her again as she was lying there.

The couple’s three young children were in the home at the time of the shooting. They were not harmed during the incident and were taken into custody by DCS and placed in the home of a family friend.
